Residency Through Arraigo
Residency Through Arraigo
Social Roots
This permit is designed for foreigners who are in an irregular situation but have established roots in Spain. The main requirements include a continuous stay in the country for at least three years, with absences not exceeding 120 days. The applicant must have no criminal record in Spain and in the countries where they have resided in the last five years. To apply, it is necessary to have a full-time work contract of at least one year or a social roots report that verifies family ties with a resident in Spain or a social integration report issued by social services.
Family Roots
Family roots are distinguished by not requiring a minimum residence time in Spain or proof of financial means from the applicant. This authorization is granted under exceptional circumstances to those with a direct family relationship with a Spanish citizen or an EU citizen. The most common situations include being a parent of a minor with Spanish or EU nationality or being the spouse or registered partner of a Spanish citizen. In the case of being a relative of a Spanish citizen, the new card for family members of Spaniards is also a viable option.
Roots for Training
One of the most significant novelties in immigration regulations. What was previously known as roots for training has been renamed to socio-educational roots with important changes. This permit is granted to foreigners in an irregular situation who have resided in Spain for at least two continuous years. The main requirement is the commitment to enroll in vocational training aimed at employment, such as a Professional Certificate or a Medium-Level Vocational Training. Language or basic computer courses are not valid. The most relevant novelty is that this permit now allows working up to 30 hours per week while undergoing training, a fundamental advantage that did not exist before.
